  1. About My Tiny

Welcome to My Tiny, where preloved meets parenthood. My Tiny is a peer-to-peer marketplace which allows users, once registered, to buy and or sell items that fall into the categories outlined in this document below (qualifying items: section 19). Section 20 also details items that are prohibited, ensure you read these carefully.

My Tiny does not charge a user or listing fee, but takes up to 7% commission once an item has been sold from the seller. (This excludes a transaction fee of 2.90%+0.30p which are PayPal’s transaction fees.)  The 1% donation to charity comes directly from any profit My Tiny makes.

The Service is operated by My Tiny Limited, incorporated and registered in England and Wales under company number 13198891 (“we”, “our, or “us”).

 

  1. Your relationship with My Tiny

This document and any documents referred to within it (collectively, the “Terms of Service”) sets out the terms of your relationship with us. Ensure you read the Terms of Service thoroughly and if there is anything within them that you do not understand, then please contact us to discuss what this means for you.

By registering an account with us and/or using and accessing My Tiny you agree to and accept these Terms of Service in their entirety. If you do not agree to these Terms of Service, you may not use My Tiny.

My Tiny is not intended for use by children under the age of 18 years old.   If you are under 18, a parent or guardian (who is 18 or over) must register to use My Tiny on your behalf. Your parent or guardian shall be responsible for supervising your use of the Services at all times and ensuring that you comply with these terms. Any breach of terms, will be the responsibility of your parent or guardian and they will be held responsible.

 

  1. Privacy information

Your privacy is of the utmost importance to us. Read our Privacy Policy which outlines how we protect you and your data.

  1. Setting up an account

To access our Service, you must register with My Tiny and set up an account with a username and password. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols).
2. You are responsible for maintaining the confidentiality of your login details and activities. If you have any concerns about your My Tiny account, you should contact us at straight away to let us know. If you suspect that your account has been misused or suspect that anyone other than you knows your account details then you must immediately inform My Tiny and either change your account details or disable your account before registering a new one.

 

  1. My Tiny Marketplace and Payments

Our Service allows you to buy and sell items in an easy and secure way.

When a user of My Tiny purchases an item this is classed as a sales transaction and must be honoured as set out in the Terms of Service agreement.

Sale transactions may only take place via PayPal.

To use PayPal to make or receive payment, you need to ensure you have a PayPal account to use the Service. You must be over 18 years old to use My Tiny.

We use a third-party service provider to process your payment and to store your credit or debit card information. When using our payment services, you agree with our provider’s conditions and terms. My Tiny will not be liable for the acts or omissions of such third party. You shall be solely responsible for the transmission of information connected to your credit or debit card, or PayPal and we hereby exclude all liability to the extent permitted by law.​

To safeguard the interests of our users, you are not permitted to sell or purchase an item by making direct arrangements with the buyer or the seller. This means you cannot arrange to pay them in person or to use another payment method other than what is offered on the My Tiny website. Please note that selling or purchasing an item in any other way is a breach of our Terms of Service and may result in the suspension and/or deactivation of your account.

Any agreement for and/or purchase of an item/items is made solely between you and the seller.  To this end, the seller must take full responsibility for the description of the item (including where appropriate: category, gender, size and most importantly condition). If, as a buyer, you have an issue with the item then the communication must take place between the seller and the buyer to rectify any concerns, disputes or complaints. Where this cannot be achieved, please contact My Tiny.

My Tiny takes no responsibility for the information provided by the sellers.

Buyers are only allowed to terminate a transaction with a seller to the extent permitted by law.

Sellers are only allowed to terminate a transaction with a buyer to the extent permitted by law.

  1. Your right to use the Service

The intellectual property (IP) rights in all materials and content comprising My Tiny, including but not limited to images, written content and designs on each page of the My Tiny website, either belong to us or we have permission from the owner to use them. All such intellectual property is protected by worldwide intellectual property laws, including copyright and design laws.

Your right to use My Tiny is personal to you and you are not allowed to give this right to another person or to sell, gift or transfer your account to another person.
3. Other than as allowed in these Terms of Service or by us in writing, you are not given the right to use the “My Tiny” name, or any of the “My Tiny” logos, domain names and other distinctive brand features, all of which are intellectual property rights that belong to My Tiny.

  1. Your content

Our right to use your User Content does not in any way affect your privacy rights and we will only use information that identifies you as set out in our Privacy Policy.

We may take information from your advertisement(s) to use on our social media pages (www.instagram.com/mytiny_preloved and/or www.facebook.com/MyTinyMarketplace

  1. Rules of Acceptable Use

In addition to the other requirements within these Terms of Service, this section describes specific rules that apply to your use of My Tiny (the “Rules of Acceptable Use”).

You must make sure the email address you provide in your account details remains active and is checked by you on a regular basis as this is how we will communicate with you.

When using My Tiny you must not:

1a. Create more than one user account on My Tiny.

1b. Give any false or misleading information in your account details.
1c. Allow another person to use My Tiny under your name or on your behalf unless authorised by you.
1d. Use My Tiny if we have suspended or deactivated your account.
1e. Send junk, spam, repetitive messages or messages that are derogatory in any way.

1f. Submit or contribute any content (including comments and descriptions relating to sale items) that contains unlawful content, nudity or violence, is abusive, bullying, threatening, harassing, obscene, misleading, untrue, offensive, defamatory, derogatory or uses bad or rude language. To this end, My Tiny will deactivate your account if you are found in breach of this term.

1g. Engage in any selling or buying of any items that fall into our prohibited items list – read the list here

1h. Purchase or sell an item by making direct arrangements with the buyer or the seller to use a payment method other than PayPal or World Pay.

1i. Modify, interfere, intercept, disrupt or hack the Service.
1j. Misuse My Tiny by knowingly introducing viruses, trojans, worms, logic bombs or other malicious and harmful material(s) that would endanger the security and safety of My Tiny (its content and programming) and/or its users.

  1. Failure to comply with the Rules of Acceptable Use constitutes a serious breach of these Terms of Service, and may result in our taking all or any of the following actions (with or without notice, and entirely at our discretion):
  • immediate, temporary or permanent withdrawal of your right to use My Tiny;
  • immediate, temporary or permanent removal of any content (including the removal of sale items);
  • issuing of a warning to you;
  • Start legal action against you including proceedings for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
  • disclose information to appropriate authorities as we reasonably feel is necessary.
  • We may investigate any suspected breach of the Rules of Acceptable Use. During such investigation we may temporarily withdraw your right to use My Tiny or remove content (including the removal of sale items, without notice to you.

The responses described in above (8.2) are not limited, and we may take any other action we reasonably deem appropriate.

  1. Data

When using My Tiny you must not:
1. Collect any data from My Tiny other than in accordance with these Terms of Service.
2. Unfairly or unlawfully interfere or manipulate My Tiny’s ratings system or user feedback system.
3. Submit or contribute any content without the permission of the content owner, or otherwise infringe the copyright, trademark or other rights of third parties.

4.Submit or contribute any information or commentary about another person without that person’s permission, or post private or confidential information via My Tiny. This includes without limitation, your or any other person’s bank information, personal information (such as date of birth, passport details, NI numbers), non-public phone numbers or non-public email addresses.
5. Mine data, screen scrape or crawl any part of My Tiny.
6. Disassemble, decompile or reverse engineer any part of My Tiny.
7. Adapt, copy, vary, edit, distribute or commercialise any content without the prior written consent of My Tiny.
8. Evade any technical measures implemented to protect or provide the My Tiny and its uses.
9. Use any third party’s PayPal account unless you have express permission from them to do so.

  1. Advertisements on the Service

If you wish to advertise on My Tiny you should contact us using the contact form whereby fees can be discussed.

  1. Seller commission

The seller of any item will pay us a commission on the total transaction amount received by the seller (including VAT and any other applicable taxes, if any, and shipping costs). This commission fee will be taken before the money from the sale(s) is paid to you. You do not need to do anything.

My Tiny’s commission is: 7% which is deducted from the sale item amount.
PayPal will charge you a fee of 2.9% + 0.30p and you should ensure you are familiar with PayPal’s terms of use which you will have agreed to when you set up your PayPal account.
My Tiny’s Commission with be deducted from your PayPal account or the funds transferred to you.
12. Deactivating your account

  1. If at any time you decide you can no longer agree to these Terms of Service or any changes made to the Terms of Service or the Service, you must immediately stop using My Tiny.
  2. To delete your account you need to login to your user profile and click the deactivate link.You’ll only be able to delete your account once all sales are completed. After you delete your profile, all information related to it (e.g. feedback and items) will be permanently deleted.
  1. We may immediately end your use of My Tiny if you break the Rules of Acceptable Use, any other important rule(s), or terms and conditions we set for accessing and using the Service including these Terms of Service. If you are concerned that someone is misusing the service then please inform My Tiny.
  2. We may also withdraw the Service for any reason, without notice, at any time and without any liability to you

12. Our liability/responsibility to you

As previously mentioned, My Tiny takes no responsibility for the sales of any item(s). The contract is between the buyer and the seller and thus it is important that both the buyer and seller know what they are entering into. My Tiny makes no commitments regarding the items including the quality, any misinformation regarding the price, description and availability of, or any information relating to any Sale Items promoted or available through our Service, or the ability of the buyer to complete any purchase of the Sale Items.

We endeavour to make the Service available as much as possible, but there may be occasions when the Service may be interrupted, including for scheduled maintenance, upgrades and emergency repairs, or due to failure of telecommunication links and/or equipment.

We will inform you of any breaches to the Service via the email provided when registering your account.

My Tiny is not responsible or liable for any loss or harm caused by viruses, worms or other programmes designed to impair the Service.

You may be able to access third- party links/websites/products via the Service. However, My Tiny is not responsible or liable for any third-party links/websites/products which may be accessed by you at your discretion. Your access to and use of such third-party links/websites/products and services shall be solely at your own risk and subject to your acceptance and compliance with the separate terms and conditions of such third party.

  1. Returns and refunds

My Tiny takes no responsibility for facilitating refunds. Any refunds must be resolved between the buyer and the seller. Any agreement for and/or purchase of an item/items is made solely between you and the seller.  To this end, the seller must take full responsibility for the description of the item (including where appropriate: gender, size and most importantly condition).

If, as a buyer, you have an issue with the item then the communication must take place between the seller and the buyer to rectify any concerns, disputes or complaints. Where this cannot be achieved, please contact My Tiny.

If the item you receive is ‘not significantly as described’ you may be entitled to a refund under ‘buyer protection’, visit the payment gateway’s respective websites for further details. You cannot return an item if it meets all of the seller’s description or just because you no longer want it/like it.

Please note that any item(s) must be returned in the condition in you receive it. You cannot use the item before returning it.

Do not return an item without agreeing it with the seller. If you are unhappy with a seller (for any reason), please report them to My Tiny.

Note, My Tiny is unable to intervene in disputes unless there is proof the item has been sent as ‘signed for’.

  1. Postage/collection

The seller is responsible for the postage of the item/items to the buyer. The postage options should be advertised along with your item. You may choose more than one option e.g small parcel and collection.

Items should be sent to the buyer within 5 business days of the transaction taking place. It is in the seller’s interest to obtain and retain a postage receipt.

My Tiny declines all responsibility for items which become lost, damaged or destroyed by a postal service. Sellers should send the item(s) as ‘signed for’ or with the respective insurances (depending on what is being sent).

If a buyer does not receive their goods, then the seller is responsible for providing them with a full refund unless you can provide tracking information showing that it was successfully delivered.

There should no charge for collection. Due to current COVID-19 circumstances, all social distancing and government guidelines/rule must be adhered to by the seller and buyer. Please see the COVID guidance set out in the FAQs.

Changes to the Service

We may update and improve My Tiny to ensure the best functionality and service for you. Improvements and updates are also made to reflect changing technologies, tastes, behaviours and user feedback.

In order to do this, we may need to update, delete or amend parts of the Service. Any significant changes to the Service will be reflected in our Terms of Service. At this point, you will be notified and then bound to the new Terms of Service.

 

  1. Law and general provision

As we are based in England, English law will apply to all disputes and the interpretation of these Terms of Service. The English courts will have non-exclusive jurisdiction over any dispute arising from or related to your use of the Service.
2. No third party or (except, where applicable, the permitted assign of My Tiny) is entitled to the benefit of these Terms of Service under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

Your feedback is important to us. We value your opinions and are always looking for ways to improve/hone what we do. That said, if we may any changes as a direct result of your feedback My Tiny will not make any payment to you. Use our contact form to get in touch

  1. Qualifying items

This list details the categories of items that can be sold using My Tiny. See below for prohibited items and use.

  1. Baby and children’s clothes
  2. Baby and children’s shoes
  3. Baby and children’s accessories
  4. Nursey/bedroom décor
  5. Nursery/bedroom furniture
  6. Maternity wear
  7. Nursing accessories and equipment
  8. Baby food (unopened and with clearly visible expiration date)
  9. Vitamins (conception, pregnancy, breastfeeding, baby, toddler – unopened and with clearly visible expiration date)

You may list bundles of items providing that these are not listed separately on the site.

Advertising items on other sites is permitted however it is not recommended due to the purchasing capability of My Tiny.

  1. Prohibited items:

This list of prohibited and restricted items is not exhaustive, and is intended only as a guide.

My Tiny reserves the right to determine what items are or are not allowed to be listed on our site at any time and we reserve the right to remove any posts if we find that they breach of our Terms of Service.

  1. Any item that does not ‘fit’ the baby, toddler, child or maternity market. See our Terms of Service for all qualifying items (section 19).
  2. Baby/toddler food or edible items that do not have a clearly marked expiration date shown in the listing.
  3. Counterfeit items, replicas and or unauthorised copies of items.
  4. Drop-shipping of any item(s). Please note that handcrafted items and those produced or printed (providing they do not infringe copyright rules) by the seller are allowed.
  5. Medicines, medical devices and healthcare products with the exception of vitamins provided the product is new and sealed and the expiration date and list of ingredients is clearly visible
  6. Recalled items – any products that have been recalled by the manufacturer or other agency. For further information please visit the relevant regulatory website.
  7. Services – including but not restricted to: babysitting, sleep consultants, baby and toddler classes. If you wish to advertise your services, please contact us using the contact page.
  8. Technology and electronics – any items sold under this category must adhere to strict health and safety guidelines. It is prohibited to sell any items which have been modified, tampered with or are not working (unless clearly stated).
  9. Any item that is faulty or poses a risk of harm and or injury/death.
